Welcome to Decked.

These Terms and Conditions ("Terms") govern your access to and use of the Decked mobile application, website, and related services (collectively, the "Platform"), operated by Peak Hit Technologies (Pty) Ltd ("Peak Hit Technologies", "Decked", "we", "our", or "us").

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

1. About Decked

Decked is a social discovery and relationship platform designed for cruise ship crew members to connect, communicate, build friendships, network, and form personal relationships with other users.

Decked is independently owned and operated by Peak Hit Technologies (Pty) Ltd and is not affiliated with, endorsed by, sponsored by, or operated by any cruise line, cruise operator, shipping company, or employer unless expressly stated otherwise.

2. Eligibility

To use Decked, you must:

  • Be at least 18 years old.
  • Have the legal capacity to enter into binding agreements.
  • Provide accurate and truthful registration information.
  • Not be prohibited from using similar services under applicable laws.

By creating an account, you confirm that you meet these requirements.

3. Account Registration

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activities that occur under your account.
  • Keeping your account information accurate and up to date.

You may not:

  • Create multiple accounts to bypass restrictions.
  • Impersonate another individual.
  • Use false identity information.
  • Transfer your account to another person.

4. User Profiles

Users are solely responsible for the information, photographs, and content they upload.

You agree that:

  • Your profile information is truthful.
  • Photos belong to you or you have permission to use them.
  • You will not upload misleading, offensive, illegal, or copyrighted material without authorization.

Peak Hit Technologies reserves the right to remove any content that violates these Terms.

5. Acceptable Use

You agree not to:

  • Harass, threaten, intimidate, or abuse other users.
  • Share hateful, discriminatory, or offensive content.
  • Send spam or unsolicited commercial communications.
  • Engage in fraudulent or deceptive activities.
  • Solicit money, investments, loans, or gifts from other users.
  • Share another person's personal information without consent.
  • Use the Platform for illegal purposes.

Violation of these rules may result in account suspension or permanent termination.

6. User Interactions

Decked provides a platform for users to connect but does not verify every user, statement, profile, or interaction.

You acknowledge that:

  • You are solely responsible for your interactions with other users.
  • Any meetings or communications occur at your own risk.
  • Peak Hit Technologies is not responsible for the conduct of users, whether online or offline.

Users should exercise caution when communicating with or meeting individuals they connect with through the Platform.

7. Safety

For your safety:

  • Never share financial information.
  • Never send money to another user.
  • Report suspicious activity immediately.
  • Use the block and report features where appropriate.

Peak Hit Technologies may investigate reported accounts and take action where necessary.

8. Subscription Services

Decked offers optional premium subscription services.

Premium subscriptions may provide access to features such as:

  • Unlimited likes
  • Unlimited messaging
  • Advanced search filters
  • Enhanced profile visibility
  • Additional premium features

Subscription pricing will be displayed before purchase.

9. Subscription Billing

Subscriptions may be processed through:

  • Apple App Store
  • Google Play Store
  • Other approved payment providers

Subscriptions automatically renew unless cancelled before the renewal date.

Refunds are subject to the policies of the applicable payment platform.

Peak Hit Technologies does not control refund decisions made by Apple or Google.

10. Intellectual Property

All rights, title, and interest in the Platform, including:

  • Software
  • Branding
  • Logos
  • Graphics
  • Content
  • Features

remain the exclusive property of Peak Hit Technologies (Pty) Ltd.

You may not:

  • Copy
  • Reverse engineer
  • Modify
  • Redistribute
  • Resell

any part of the Platform without written permission.

11. Privacy

Your use of Decked is also governed by our Privacy Policy.

By using the Platform, you consent to the collection, storage, and processing of information as described in the Privacy Policy.

12. Account Suspension and Termination

Peak Hit Technologies may suspend or terminate an account without prior notice if a user:

  • Violates these Terms.
  • Engages in fraudulent activity.
  • Harasses other users.
  • Uploads inappropriate content.
  • Creates safety risks for other users.

Termination may result in loss of access to messages, matches, and account data.

13. Disclaimer

Decked is provided on an "as is" and "as available" basis.

Peak Hit Technologies makes no guarantees regarding:

  • Availability of the Platform.
  • Successful matches.
  • User compatibility.
  • Continuous operation without interruption.
  • Accuracy of user-provided information.

We do not guarantee that use of the Platform will result in friendships, relationships, networking opportunities, or any specific outcome.

14. Limitation of Liability

To the fullest extent permitted by law, Peak Hit Technologies (Pty) Ltd, its directors, employees, contractors, and affiliates shall not be liable for:

  • Indirect damages.
  • Consequential damages.
  • Loss of profits.
  • Loss of opportunities.
  • Personal disputes between users.
  • User-generated content.
  • Actions of third parties.

Our total liability shall not exceed the amount paid by you to Decked during the twelve (12) months preceding the claim.

15. Indemnity

You agree to indemnify and hold harmless Peak Hit Technologies (Pty) Ltd from any claims, losses, damages, liabilities, or expenses arising from:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your interactions with other users.
  • Content uploaded by you.

16. Changes to the Platform

Peak Hit Technologies reserves the right to:

  • Modify features.
  • Introduce new services.
  • Remove services.
  • Change pricing.
  • Update these Terms.

Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of South Africa.
